Nicolas Eatery Tries Again To Move Upstairs

A Malibu restaurant plans to relocate … two stories up.

Nicolas Eatery … in eastern Malibu … has a request before the city Planning Commission tonight.

The restaurant wants to move half of its seats from its present location .. in the old Thai Dishes space … up to the roof … above the second floor.

You may remember that there was a whole lot of construction up on the roof a couple of years ago.

The restaurant had building permits to move to the roof …. but those building permits were issued in error … because there had been no planning commission approval.

Now … the Planning Commission is being asked to allow the rooftop restaurant …   … but there are other possible problems.

The small shopping center there does not have enough parking places under the city codes.

Also … it violates the rules for the size of the structure … its setbacks from neighboring structures … and its lack of landscaping along PCH.

It’s been excused from that because it was built before there was a city or any codes.

But in most cities … a major reconstruction of a building … in most cities … means that the building has to be brought up to code.

No way to do that at Nicolas Eatery …

And the city staff says the shopping center there just squeaks in below needing to be brought up to code.

We’ll see if the Planning Commission agrees on that one  … tonight.
