Texans Make Malibu Lot Line Issue A Federal Case

A Texas couple makes a Latigo Canyon property dispute into a federal case.

The Texans own a house on Ocean View Drive … up the hill from Latigo Canyon Road in th Malibu Bowl.

They accuse their next door neighbors of building a deck … that extends onto their property.

David Sacks and Deana Sacks filed a complaint twp weeks ago in the U.S. District Court .

They allege their neighbors are trespassing and creating a nuisance.

A report in a court newspaper … the Northern California Record … says the Texas couple use the home as a vacation house.

They had their lot line surveyed … and marked.

The defendants alleged excavated the property and removed the survey monument and markers.

The defendants allegedly have unpermitted structures … which violate L A County setback rules.

As Texas residents … the plaintiffs are allowed to file suit on a local matter in federal court … although a simple property dispute is usually handled in state courts.

And filing a lawsuit does not mean the facts alleged are true…
