Nobu Gets Yet Another Summer To Fix Its Parking Violations

Malibu is going to go into another summer traffic season … and City Hall still does not have a plan to unlock the daily traffic jam at the Nobu restaurant driveway entrance.

Nobu and the city -STILL- do not have an agreement on how to handle the daily traffic jam at the overcrowded restaurant.

And after more than five appearances before the Malibu city planning commissioners … the Nobu restaurant operator has now been given a drop dead warning.

Solve this by early August.

Or else.

The city will start revocation hearings … to yank the permit for the restaurant.

Residents have been complaining about Nobu causing traffic jams on the highway.

Neighbors have been complaining for 10 years about Nobu employees hogging parking psaces on PCH.

That’snot allowed by the restaurant’s Coastal Use Permit.

“This has been going on for 10 years, and Nobu has been not conforming with  the CUP for 10 years that I know of.

“And what about the city law that says ‘no offsite parking,’ which means no offsite parking?

“You cannot park across the street.

“This is a public safety issue.”

This came after complaints from Nobu’s attorney … who claims the restaurant owners are bfeuddled

“Staff mentioned one of your options is to schedule a revocation (hearing).

“I just don’t know. Based on what?

“We’re in the dark.

“We are not in violation of any provision of the Coastal Use Permit that is in operation.

“None.

“And so, today , we keep asking, what’s the basis?

“Why are you keep saying ‘you are in violation’?

“What is the violation?”

City staff begged to disagree.

Planners say they have had numerous meetings … phone calls and emails to explain to Nobu just exactly what the violations are.

Nobu is not allowed to have off site parking.

Nobu is supposed to have a parking agreement signed with the city … and with its neighbor the Soho House … to iron out details on the parking lot and PCH.

And that parking agreement is supposed to be reviewed and renewed once a year.

That has never happened.

Assistant city attorney Trevor Rusin says Nobu knows full well … what the problems are.

“You know, saying that they don’t know what the problems are?

“They are listed in the cease and desist.

“They’ve been made clear to the applicant team for some time, that they’re in violation.”

In the end    city planning commission chairman Steve Uhring says Nobu has to get its act together … one last chance.

“I have no interest in shutting down Nobu.

“All right?

“I mean, that’s the last thing I want to do.

“However.

“This problem has been going on for a very long time … and there has been with no resolution.

“And I believe the only way to get a resolution is to put a time frame around it.”

And that time frame is early August.

Unless there is an agreement made between Nobu and city staff … Malibu’s planning commission will meet in August to set a revocation hearing for Nobu’s conditional use permit.
