Malibu Lawyer Sticks It to SM Again – Sues SMMUSD Over Costs

Malibu attorney Kevin Shenkman has won an early skirmish in a lawsuit he has filed against the Santa Monica-Malibu Unified School District.

He claims that the District illegally requires students to purchase items needed for school — such as supplies, uniforms and field trips — in violation of California’s Education Code and Constitution.

A Superior Court Judge this week rejected a motion by the district to dismiss the lawsuit.

The district had argued that Shenkman’s clients needed to exhaust administrative remedies … They needed to first ask the district to change its policies.

Shenkman showed that they had already done that.

The judge rejected the district’s arguments there.

And the judge also rejected applications from several Santa Monica-Malibu special interest groups to file an “amicus curiae” briefs in the case.

The Santa Monica Education Foundation and several unions … plus the League of Women Voters of Santa Monica and Santa Monicans for Renters’ Rights … were rejected from participating in the case.

It now moves to pretrial procedures like discovery.

The Malibu attorney .. Kevin Shenkman … has been a major pain in the tookus for the establishment in Santa Monica.

He has also raked Santa Monica city council members over the coals … in his so-far successful lawsuit to change the voting procedures for elections in Santa Monica.
